The products presented on the"www.bastilleparfums.com" website (hereinafter referred to as the "Site") are sold directly by ESTER, a simplified joint stock company with capital of 3,454.47 euros, registered with the Créteil Trade and Companies Register, having its registered office at 5, avenue du Général de Gaulle, 94160 Saint-Mandé, France, hereinafter referred to by its commercial name, "BASTILLE".

Purchases of products offered by the Site are subject to these terms and conditions of sale (hereinafter, the "GTC") and we invite you to read them carefully. By validating your order, you confirm that you have read and accepted these GTC without reservation or restriction.

These T&Cs may be changed at any time without notice by BASTILLE, and the applicable T&Cs will be those in effect at the date of your order.

Where applicable, these GTC shall take precedence over any other version or any other contractual document.

1. PRODUCTS AND PRICES

Bastille offers a range of products which may be modified at any time at Bastille 's sole discretion (hereinafter, the "Products").

The main characteristics of the Products and the commercial offers related to these products are presented on the Site.

If you have any questions about the Products, you can contact our customer service department at hello@bastilleparfums.com.

The prices of our Products are indicated in Euros, all taxes included, with the French VAT applicable on the day of the order. Any change in the legal rate of VAT will be reflected in the price of the Products presented on the site, on the date it comes into force.

The prices of our Products do not include delivery costs which may be charged in addition depending on the shipping address.

In the event of an order to a country other than metropolitan France, you are the importer of the Product(s) concerned. Any customs duties or other local taxes that may be required will be at your expense. They are your responsibility, both in terms of declaration and payment to the authorities and competent bodies in your country.

The payment requested corresponds to the total amount of your order, including delivery costs.

Bastille reserves the right to modify the prices of its Products at any time and without prior notice. Products are invoiced on the basis of the prices shown on the site at the time your order is placed, subject to availability of the Products at that time.

2. ORDERING PROCESS

The ordering process consists of the following steps:

On our website you can find out about the Products by reading their description.

Select the Products you wish to order in the quantities you require.

Add them to your basket.

Complete the information requested by filling out the form and following the instructions or by creating your customer account.

Choose a delivery method.

Choose a payment method.

Check the details of your order, its content, the quantity of Products ordered, its total amount, including the shipping costs according to the delivery method you have chosen. Correct any errors before confirming your order.

Confirmation of the order implies acceptance of all the provisions of these GTC and constitutes proof of the existence of the contract of sale.

An order confirmation will be sent to you by e-mail.

3. PRODUCT AVAILABILITY

Product offers are valid as long as they are visible on the site, within the limit of available stocks. Bastille informs you of the availability of Products sold on the site at the time of order validation.

If, despite the vigilance of Bastille, the Products ordered are unavailable, we will inform you by e-mail as soon as possible, and will offer you either to order another Product present on the site as a replacement, or to cancel your order. If you choose to cancel your order, you will be reimbursed immediately if your bank account has already been debited, and at the latest within 30 days of payment of the sum transferred.

Bastille reserves the right to refuse any order involving abnormally large quantities, or if Bastille has encountered payment difficulties with this consumer on a previous order.

4. PAYMENT

All orders are payable in euros on the site.

Any order placed on the website must be paid immediately upon validation of the order. We accept payment by credit cards, which are part of the normal credit card network (Visa, Euro card, MasterCard, American Express) or PayPal. Your credit card payment data is protected and encrypted by our service provider.

By providing your credit card details, you authorize Bastille to debit your credit card for the amount of your order.

You confirm that you are the holder of the debited payment card and that the name on the payment card is yours.

If the total price of the order has not been debited, Bastille reserves the right to cancel the order immediately. It will be your responsibility to place your order again using a valid method of payment.

Products remain the property of Bastille until full payment, including VAT, has been received.

5. DELIVERY AND RETURN

DELIVERY

Products purchased on the Site can be delivered to a postal address anywhere in the world.

Free delivery for orders over €50 in the European Union, Switzerland, the United Kingdom, Monaco and French overseas departments and territories.

Free delivery for orders over €110 in the rest of the world.

Delivery charges for purchases under €50 to France, Belgium, Luxembourg, Germany and Spain are €7.

Delivery charges for purchases under €50 to the rest of the European Union, the United Kingdom, Switzerland and French overseas departments and territories are €12.

Delivery charges for purchases under €110 to Canada, the USA and the rest of the world are €25.

After confirmation of the order and validation of the payment by Bastille, the Products will be delivered according to the means chosen among those proposed during the ordering process, and according to the following indicative delivery times, to which is added a time for processing your order and delivery to the carrier:

For France: 2 to 3 working days 

For Europe, the United States and the rest of the world: 3 to 15 working days.

Please note that international orders can sometimes take a few weeks to be delivered due to specific local customs processes.

When the package is shipped, we send you the corresponding tracking number by e-mail. From departure to arrival, you have the possibility to follow your parcel by indicating its tracking number on the carrier's website.

Customs duties and other taxes due in the country of arrival are at your expense and Bastille cannot be held responsible for any customs deductions made on the product.

RETURN

You've discovered your perfume sample and you're not sure if it's right for you? Don't worry: 50 and 100 ml bottles can be returned within 15 days if the box has not been opened and is in perfect condition ✨

Returns from metropolitan France are free!

In case of a return from outside metropolitan France, shipping costs remain at your charge.

You can download your return label by clicking on this link: www.retour.sympl.fr

Then you just have to deposit the parcel at the post office. Just remember to wrap the bottle well so that it is not damaged during transport 🖤

Finally, it is not possible to return a 15ml bottle, a discovery set or a gift box.

6. DELIVERY PROBLEMS

Delays in delivery are the responsibility of the carriers, and therefore cannot give rise to compensation on the part of Bastille.

In the event of a delay of more than 7 days, please contact us by e-mail at hello@bastilleparfums.com : we will do our best to help you.

On receipt of the package, please check the condition of the packaging and its contents. If the package has been opened or damaged, please inform us of your reservations by email.

7. RETRACTATION / RETURN / EXCHANGE

Bastille is committed to providing you with quality Products that comply with the descriptions and photos. Despite this, if you are not satisfied with your order, as a consumer you have the legal right to withdraw from a contract within fourteen (14) days of receipt of the Products without having to justify your reasons or pay any penalties. In the event of an order for several Products delivered separately, the fourteen (14) day withdrawal period applies from the date on which you receive the last item.

You must return the Products in the same conditions as those in which you received them (new, unused and unopened condition, and in their original packaging), free of charge if you are in metropolitan France, and within fourteen (14) days following the sending of the return label which will be automatically sent to you. In the case of a return made from abroad, the shipping costs are at your expense.

To request an exchange or a return, you must download your mailing label by clicking on the link: " www.retour.sympl.fr " then indicating your email or telephone number, as well as your order number. Bastille will inform you of the procedure to follow and our team will be happy to help you if necessary.

Bastille reserves the right to refuse the return, refund or exchange of any Product which has not been received within this period, or which is unfit to be marketed in new condition (e.g. Product returned incomplete, spoiled or damaged). In accordance with current legislation, the right of withdrawal cannot be exercised for Products opened by the customer or those that have been personalized at the customer's request: this is the case for our engraved bottles and gift boxes.

Bastille will make the refund within fifteen (15) working days of receipt of the returned Products, by crediting your payment card. Only our customers are entitled to a refund: if you are the lucky recipient of a gift Bastille, you will not be entitled to a refund, but you may be offered an exchange.

8. WARRANTIES

All our products are covered by the legal warranty if the Product has been used under normal conditions of use.

Article L211-4 of the French Consumer Code: the seller, Bastille, is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter is his responsibility under the contract or was carried out under his responsibility.

Article L211-5 of the French Consumer Code: To be in conformity with the contract, the goods must: 

Be fit for the use ordinarily expected of a similar good and, where appropriate, :

correspond to the description given by the seller and have the qualities that the seller has presented to the buyer in the form of a sample or model ;

have the qualities that a buyer may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling ;

Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the knowledge of the seller and accepted by the latter.

Article L211-9 of the French Consumer Code: In case of lack of conformity, the buyer has the choice between repair or replacement of the goods.

However, the seller may not proceed according to the buyer's choice if this choice entails a cost manifestly disproportionate to the other method, taking into account the value of the goods or the importance of the defect. In such a case, the seller shall be bound to proceed, unless it is impossible to do so, according to the method not chosen by the buyer. 

Article L211-10 of the French Consumer Code: If the repair and replacement of the good are impossible, the buyer may either return the good and be reimbursed the price, or keep the good and receive part of the price.

The same faculty is open to them: 

If the solution requested, proposed or agreed upon in application of article L. 211-9 cannot be implemented within one month following the buyer's complaint ;

Or if this solution cannot be implemented without major inconvenience for the buyer, given the nature of the goods and the use he is seeking.

However, the sale may not be cancelled if the lack of conformity is minor. Article L211-11 of the Consumer Code: The application of the provisions of articles L. 211-9 and L. 211-10 is free of charge for the Buyer.

Article L211-12 of the French Consumer Code: The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.

Article 1641 of the Civil Code: The seller is bound by the warranty for hidden defects of the thing sold which make it unfit for the use for which it is intended, or which diminish this use so much that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known about them.

Article 1648(1) of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

9. INTELLECTUAL PROPERTY

In general, the trademarks, whether figurative or not, and more generally all the logos, images, symbols and illustrations appearing on the Site and/or on the Products and their packaging, whether registered or not, (hereinafter referred to as the "Intellectual Property Rights") are and shall remain the exclusive property of Bastille, with the exception of images specifically credited. Any reproduction, copy, distribution, modification or use, in whole or in part, of these Intellectual Property Rights, for any purpose whatsoever and on any medium whatsoever, without the express prior consent of Bastille, is strictly prohibited. The same applies to any combination or conjunction with any other trademark, symbol, logo or, more generally, any distinctive sign intended to form a composite logo. 

10. LIMITATION OF LIABILITY

In no event will Bastille be liable for any indirect, incidental or consequential damages whatsoever, including but not limited to loss of business, profit or loss of opportunity arising out of the purchase of Products on the site.

The Products offered comply with current French and European legislation and standards applicable in France and Europe. Bastille is in no way responsible for non-compliance with the legislation of the country to which the product is delivered (e.g. in the event of a product ban). It is your responsibility to check with the local authorities about the possible implications of importing and using the products you intend to order.

The photographs appearing on the site are not contractual and may have been modified. Bastille cannot be held responsible for the inaccuracy of the photographs or graphic representations appearing on the site. Please refer to the exact description of each product for precise specifications.

Bastille makes every effort to keep the Site free of viruses and defects. However, we cannot guarantee that use of the Site or any linked site will not cause damage to your computer. You must ensure that you have the necessary equipment to use the Website and to block anything that could damage that equipment. We will not be liable for any loss or damage to your computer equipment arising from your use of the Site.

11. FORCE MAJEURE

The performance by Bastille of its obligations under this agreement shall be suspended in the event of force majeure for the duration thereof, including in the event of disruption, flood, fire or strike, including of postal services and means of transport or communication. Consequently, Bastille shall not be liable for any direct or indirect damage arising from such events beyond its control. In the event of force majeure, we will inform you as soon as possible and will do our utmost to keep you informed of developments.

If the suspension of the performance of Bastille 's obligations continues for a period of more than ninety (90) days, you have the right to cancel the current order and Bastille will then refund you the full amount of the order.

12. APPLICABLE LAW - DISPUTES

These Terms and Conditions of Sale and the transactions arising therefrom are governed by and subject to French law.

These GTC are written in French. If they are translated into another language, only the French text shall be authentic in the event of a dispute.

In the event of a dispute, the customer is informed that he may have recourse to the consumer mediation procedure under the conditions provided for in Title I of Book VI of the French Consumer Code.

In accordance with Article 14 of Regulation (EU) No 524/2013, the customer is also informed that the European Commission has set up an online dispute resolution platform, facilitating the independent settlement of online disputes by out-of-court action between consumers and traders in the European Union:https://webgate.ec.europa.eu/odr/

Disputes that cannot be resolved amicably will be brought before the competent French courts.

14. PERSONAL DATA

Information and data concerning you are collected by Bastille, confidentially and with the utmost care.

This data is necessary for the management of your order and for our customer relations.

It is shared only with our service providers engaged in data processing on behalf of Bastille ; for example, for the management of our website platform, the implementation of commercial campaigns, product delivery, etc. These service providers are authorized to use personal data only in connection with the services they perform on behalf of Bastille and solely for the purposes set out in this document.

These personal data are not sold.

This information and data is also kept for security reasons, to comply with legal obligations and requirements and also to enable us to improve and personalise the services we offer you and the information we send you.

In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, modify, rectify and delete any personal data concerning you. To do so, simply send an online request to hello@bastilleparfums.com indicating your name, first name and e-mail address.
